Terms of Use

Effective Date: January 1, 2026

These Terms of Use ("Terms") govern your access to and use of the website biz-lend.com (the "Site"), owned and operated by BizLend PA LLC, a Pennsylvania limited liability company ("BizLend PA," "we," "us," or "our"). By accessing or using the Site, including by submitting an application through the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

1. Eligibility

The Site is intended for use by business owners and authorized representatives of businesses seeking commercial financing. You represent that you are at least 18 years of age, are legally authorized to act on behalf of the business submitting an application, and have the authority to agree to these Terms.

2. Description of Services

The Site allows businesses to submit an online application for business financing offered by BizLend PA. Submission of an application does not guarantee approval or funding. All applications are subject to underwriting review, and BizLend PA reserves the right to approve, decline, or condition any application in its sole discretion. Any financing extended will be subject to a separate written agreement between BizLend PA and the approved applicant, the terms of which will control over any general description of products appearing on the Site.

3. Accuracy of Information

You agree to provide accurate, current, and complete information in connection with any application or other submission through the Site, and to promptly update such information as necessary. You authorize BizLend PA and its service providers to verify any information you submit, including by obtaining consumer and/or commercial credit reports and by contacting third parties, including financial institutions.

4. Consent to Electronic Communications

By using the Site and submitting an application, you consent to receive communications from BizLend PA electronically, including by email, telephone, and text message, at the contact information you provide, including for marketing purposes where permitted by law. You may withdraw consent to marketing communications at any time using the opt-out instructions provided in those communications. Message and data rates may apply to text communications.

5. Intellectual Property

The Site and all content, features, and functionality thereof, including text, graphics, logos, and software, are owned by BizLend PA or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

6. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information in an application
  • Attempt to gain unauthorized access to the Site, its systems, or related networks
  • Interfere with or disrupt the operation of the Site
  • Use any automated means, including bots or scrapers, to access the Site without our prior written consent

7. Third-Party Links

The Site may contain links to third-party websites that are not owned or controlled by BizLend PA. We are not responsible for the content, privacy practices, or terms of any third-party website.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIZLEND PA AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless BizLend PA and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your submission of inaccurate or fraudulent information, or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.

12. Dispute Resolution; Venue

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may modify these Terms at any time. The "Effective Date" above reflects the date these Terms were last revised. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, BizLend PA, or third parties.

15. Entire Agreement; Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BizLend PA regarding use of the Site. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
